Terms of Service

How Nova’s design and development subscriptions work, what each of us is responsible for, and the rights that remain yours.

Last updated:

One subscription. One active request. Queue unlimited requests and revisions, pay before service, and pause or cancel without a long-term commitment.

A subscription month means 30 active UTC calendar days. Mandatory consumer rights take priority over these terms and our Refund & Cancellation Policy.

1. About Nova & these terms

Nova Studios is a South African sole proprietorship providing design and web-development services. General enquiries go to hello@novastudios.co.za; payment, cancellation and refund enquiries go to billing@novastudios.co.za.

These terms describe the subscription offered with the plan and any specific scope agreed for your work. Review the applicable terms, price and payment details before buying. An enquiry does not create a paid subscription. Availability is shown before checkout; a page describing a plan does not mean checkout is open.

If you arrange services for a business, you must have authority to do so. Any particular deliverables, dependencies or deadlines agreed with Nova should be recorded in writing so both parties can refer to them. Mandatory legal rights apply regardless of anything stated here.

2. Services, requests & revisions

Design covers ongoing web and landing-page design, product UI/UX, branding, visual identity, marketing assets, presentations, motion and interaction design, and Framer/Webflow implementation. Design + Build includes Design plus custom web-product development, frontend and backend work, databases, authentication, payments, APIs, integrations, AI features, automations and deployment work within the agreed scope.

You may add unlimited requests to your queue and request revisions to the work. Nova works on one active production request at a time per subscription. Unlimited refers to the queue and revisions, not parallel production or a guaranteed number of completed deliverables in a month.

Work is primarily asynchronous, using Trello for requests, priorities, review and handover, with email for communication and notices. Identify the next priority in your queue. Larger projects are divided into sequential, reviewable pieces. Review and feedback guide revisions; there is no automatic acceptance deadline.

Timing depends on the request’s size, complexity, dependencies and feedback. Discuss time-sensitive work before starting. General turnaround descriptions are not a guaranteed delivery SLA. Nova remains responsible for performing agreed services to applicable legal standards and communicating material delays.

3. Working together

Provide a clear brief, accurate content, relevant references, timely feedback and the permissions or access reasonably needed for the request. Let Nova know about technical constraints and deadlines. Delayed information or feedback may delay work; it does not automatically pause your subscription. Use the pause control when you want to preserve future paid dates.

Only provide material and access you are entitled to share. Do not put passwords, full card details, sensitive personal information or confidential access credentials into ordinary enquiry forms or request descriptions. Arrange an appropriate secure method before sharing necessary access or sensitive project information.

Hosting, domain names, platform subscriptions, paid software, third-party licences and API usage charges are separate unless expressly agreed otherwise. Discuss required third-party services and costs before they are incurred; these terms do not authorise open-ended external spending.

4. Plans & prepaid payment

Design
$3,499/month
Design + Build
$5,999/month

Customers pay before service. One month purchases 30 active UTC calendar days under the rules below. There is no long-term commitment.

Advertised prices are in US dollars. Paystack checkout collects the displayed ZAR amount using Nova’s disclosed, manually maintained fixed conversion rate, rather than a live FX feed. Review the actual amount, currency and rate before authorising payment. Your card issuer’s conversion or charges may differ from the advertised USD figure.

A payment must be successfully and independently verified before it grants paid capacity. A checkout redirect, pending payment or failed payment does not establish successful payment. If the result is uncertain, contact billing support with the reference rather than paying repeatedly. Applicable charges and any separately agreed costs must be made clear before you approve them.

6. Pause, resume & cancellation

You can pause at any time. The UTC date on which you pause is an active date; unused hours of that date are not saved. Future dates spent fully paused do not consume remaining paid days. No renewal is initiated while paused.

You may resume using your remaining paid days. The resume date counts once; repeated pauses and resumes on the same UTC date do not count that date twice. Resuming with zero paid days does not activate service and defers renewal eligibility to the next UTC midnight. Successful payment is still required.

You can cancel at any time without a cancellation fee. Cancellation stops future automatic-renewal requests but does not itself pause active-day consumption or forfeit unused prepaid capacity. You may still use, pause and resume your paid days. Resuming does not restore cancelled recurring authorisation.

Use the subscription-management link supplied with your purchase. If you cannot access it, email billing@novastudios.co.za. A charge already in flight may still complete after an instruction; contact us to investigate its timing and your rights. Cancelling renewal is separate from a statutory cancellation or refund request.

7. Authorised automatic renewal

Automatic renewal requires your explicit authorisation of the displayed recurring terms and a supported reusable payment method. Leaving recurring authorisation unchecked makes the purchase prepaid-only. No customer is automatically charged merely because they have bought once or saved a payment method.

Where available and authorised, renewal may be attempted at the agreed ZAR price only after the final paid active date has ended, aligned to UTC midnight. Paused or cancelled renewal is not eligible. A successful verified payment is required for another allocation. Payment failures or additional bank authentication do not grant unpaid service.

The availability of automatic renewal is confirmed in the purchase experience. These terms do not switch on a payment feature that has not been made available.

8. Refunds & consumer rights

The Refund & Cancellation Policy forms part of these service terms. It provides a full voluntary refund of the initial payment when requested within 48 hours, before you submit a work request and before Nova begins providing services. Submission of a work request or expiry of 48 hours, whichever occurs first, ordinarily ends that voluntary change-of-mind offer.

That cutoff does not remove statutory rights. Submitting a request alone is not proof of services actually begun with your consent. Applicable ECTA cooling-off rights, CPA service-quality remedies and mandatory protections in other jurisdictions remain available. Unused allocation is not automatically refundable simply because it was not used, subject to those rights.

Duplicate, incorrect or unauthorised charges and failures to provide agreed services are investigated separately from voluntary change-of-mind requests. Consult the refund policy for applicable deadlines and contact billing@novastudios.co.za for assistance.

9. Your work & third-party materials

Completed design files and code produced for your business belong to you once paid for. You retain your rights in the content and materials you supply; Nova uses them for the agreed work.

Third-party fonts, stock assets, software, open-source components and hosted platforms remain subject to their own ownership and licence terms. Nova cannot transfer rights it does not hold. Relevant third-party materials, required permissions and costs should be identified for the work so you can use the deliverables as intended.

If a request would incorporate Nova’s pre-existing materials, any retained rights and the permissions needed for your use must be identified and agreed before inclusion. This is not a blanket reservation of rights in paid custom work, nor permission to reuse your confidential work or publish it in a portfolio.

10. Confidentiality & permitted use

Non-public business and project information shared for the work is to be treated confidentially and used for providing or administering the agreed services. Necessary disclosure to authorised service providers must respect confidentiality and applicable data-protection duties. Information already lawfully public, independently developed or required to be disclosed by law is treated according to those circumstances.

Use the service lawfully and do not request infringement of another person’s rights, unlawful access or harmful activity. Keep your secure access links private. Tell Nova promptly if access appears compromised. The Privacy Policy explains personal-information handling; it is not a substitute for any project-specific data-processing arrangement that is needed.

11. Ending the service

You may stop future renewals as described above. Production work cannot continue without paid active capacity. When a request is outside the agreed plan, cannot lawfully proceed or depends on missing access, Nova will discuss the issue and next steps rather than silently changing the subscription’s scope or price.

If a service agreement must end because of a material problem, any notice, opportunity to remedy, paid-capacity treatment and refund must respect the agreement and applicable law. This clause does not create an automatic forfeiture of paid days or an unrestricted right to cancel your service without a remedy.

12. Problems, responsibility & disputes

Raise service concerns through your project communication or hello@novastudios.co.za, and billing concerns through billing@novastudios.co.za. Describe the problem and the outcome you are seeking so it can be investigated and an appropriate remedy considered.

Nova remains responsible for its obligations and failures to the extent required by applicable law. These terms do not exclude statutory guarantees, remedies for defective services, or liability that cannot lawfully be excluded. They do not impose a fixed monetary liability cap, a blanket exclusion of losses or an indemnity on you.

You may use an appropriate court, consumer authority, bank or payment-provider dispute process without first exhausting our support process. Nothing here imposes mandatory arbitration, an exclusive foreign forum or a waiver of mandatory rights. Relevant South African law and any other mandatory law applicable to your transaction must be respected.

13. Changes & related policies

Future versions will show an updated date. Posting a revision does not retrospectively change an existing purchase’s agreed price, paid capacity or accrued rights. Material changes affecting ongoing services must be communicated and agreed where required.

Read these terms with our Refund & Cancellation Policy and Privacy Policy. If wording conflicts with mandatory law, that law takes priority.
